1. Introduction

Welcome to PRAD Travels & Hospitality Pvt. Ltd. By accessing and using our website and services, you agree to comply with and be bound by these Terms & Conditions. If you do not agree with any part of these terms, please do not use our services.

PRAD Travels & Hospitality Pvt Ltd, hereinafter referred to as “The Company”, offers to the client the opportunity to make reservations for tours, accommodations, car rental, cruise, rails, flights & other travel related services etc., for leisure purpose and corporate travel, for destination services with selected suppliers with which ‘PRAD Travels’ entertains regular business connections in Indian Subcontinent and Worldwide

Rates and services are subject to change until confirmed in writing. The clients will be advised of any changes in a timely manner. The principals invoice ‘The Company’ and ‘The Company’ invoices the clients according to terms and conditions of the present agreement. The client will pay for the invoice raised by ‘The Company’.

The use of “The Company’s” logo and the legal name without prior explicit written approval from “The Company” is strictly prohibite.

 

2. Rates Include & Exclude

2.1 Room rates include room charges, breakfast as indicated, local taxes, resort fee (if any) and services charges (if any)

2.2 Standard check-in / Checkout time in most hotels is 1400 Hrs. (IST). Therefore the cost of early check-in or late check-out is not included in the tour cost. We can always make a request for early check-in or late checkout if required but we do not guarantee that, that entirely depends upon the policy of the hotel, time of the year and availability of the room.

2.3 It is customary and most times mandatory for certain hotels to request a credit card deposit by the clients upon check-in to cover any incidental charges.

2.4 Room rates exclude any surcharges applicable during high season, festive season,, blackout dates due to conferences & conventions; compulsory gala event supplements etc.

2.5 Airfares quoted/included are for economy class unless otherwise specified and include prevailing taxes at the time of booking. Airfares exclude seat allocation charges and inflight meals, if not covered in airfare and/or in case of low cost economy carriers.

2.6 Package rates exclude porterage, tips, travel insurance, expenses of personal nature such as laundry, mini bar, phone calls, camera fee, table drinks etc

2.7 Package rates exclude entrance fee to places of visit and services of guides /escorts etc. unless otherwise specified.

2.8 Package rates exclude any joy rides like boat rides, yacht rides, animal rides (camel/elephant/pony etc); jungle safaris; jeep rides/safaris; palanquins, any other adventure activities unless otherwise specified

2.9 Package rates exclude any sightseeing tours/excursion or transfers, which are to be managed and provided mandatorily by local taxi unions of the area.

2.10 Package rates; sightseeing and excursion rates exclude any govt. permits which are required prior to visiting the restricted areas

2.11. Service of vehicle shall not be at disposal basis. The services of the vehicle shall be on the point to point basis and strictly as per the itinerary

2.12 ‘The Company’ shall not be liable for any extensions or changes or charges to the additional services other than covered by the voucher

2.13 Any supplementary services and /or assistance like Wheel Chair or any other services required for specially abled people are not included in the cost.

2.14 The Price of your travel arrangements is subject to surcharges in case of sudden hike in fuel prices, scheduled airfare and any taxes levied by the government. Any such hike shall be passed on to the clients

 

3. Rights and Responsibilities

3.1 ‘The Company’ reserves the right to modify, suspend, or discontinue any services (or any part of services) at any time without prior notice.

3.2 ‘The Company’ is not liable for any loss or damage arising from the use of our services or from any changes, suspension, or discontinuation of services.

3.3. ‘The Company’ does not own or control or manage or operate hotels, restaurants, car, coach, cruise, airlines, sightseeing/excursions services, safaris, parks, and other facilities  and services mentioned in the tour. As a facilitator of the services between the clients and service providers ‘The Company’, cannot be held liable.

-Where there has been no fault on the part of ‘The Company’, or its suppliers or agents.

-Where the failures in performance of the contract are attributable to the customer.

-Where the failures are attributable to a third party not connected with the provision of our services and are unforeseeable or unavoidable.

-Where the failures are due to unusual and unforeseeable circumstances beyond your control.

3.4. We do take all reasonable steps in ensuring that the organization maintains standards and provides a service that is acceptable to the passengers.

3.5 In case of events and circumstances beyond our control, we reserve the right to change all or parts of the services for safety and well-being of our clients

3.6 Travel documents, including visas as well as the compliance with custom regulations are the responsibility of the passengers. “The Company” shall not be responsible for costs incurred by the passengers not having proper travel documentation.

3.7 All services are subject to the laws of the country in which they are provided and to the conditions specified by the relevant suppliers. “The Company” is not liable for any injury, damages, loss, delay, or any other consequential damage to any person or property which may occur through any default, act or omission of any company or person rendering any of the services included in the arrangements or otherwise in connection therewith or any proprietor or employee. “The Company” shall not be liable for any consequential, incidental, special or punitive damage whatsoever.

3.8 The issuance of tickets, vouchers and/or coupons shall be deemed to be consent to the terms and conditions laid down in this document. ‘The Company’ shall not take any responsibility for losses or accidental expenses due to delay or changes in the schedules, defaults or overbooking by hotels/airlines or any other service provider, sickness, weather, strikes, war, quarantine or any cause beyond its reasonable control. All such losses or expenses are the responsibility of the provider of the service or the passenger. The passenger bears the risk of loss of all his/her personal possessions unless the passenger elects to obtain insurance on the same. “The Company” strongly recommends that appropriate insurance must be obtained prior to departure.

 

4. Limitation of Liability

4.1 To the maximum extent permitted by law, PRAD Travels & Hospitality Pvt Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or other damages arising from your use of or inability to use our services.

4.2 PRAD Travels & Hospitality Pvt. Ltd. accepts the liability for those arrangements for your services, which are wholly within our control and therefore, accept liability to clients for the negligence of our employees. However, we would like to draw attention to the following circumstances, which fall outside our direct control and hence we shall not accept any liability.

-Where there has been no fault on the part of ‘The Company’, or its suppliers or agents.

-Where the failures in performance of the contract are attributable to the customer.

-Where the failures are attributable to a third party not connected with the provision of our services and are unforeseeable or unavoidable.

-Where the failures are due to unusual and unforeseeable circumstances beyond your control.

4.3 ‘The Company’ shall, in no circumstances whatsoever be liable to the client or any person travelling with him or her for: Any death, personal injury, sickness accidents, loss delay, discomfort, increased expenses, consequential loss and / or damage or theft howsoever caused;

4.4 Any act, omission, default of any independent contractor or other person or by any servant or agents employed by them who may be engaged or concerned in the provision of accommodation, refreshment, carriage facility or service for the client or for any person travelling with him however caused. PRAD Travels & Hospitality Pvt. Ltd shall not take any liability whatsoever arising due to circumstances beyond our control such as natural disasters, industrial disputes, reason of threat or war, riots, civil strife, terrorist activities, technical problems to the transport, extreme weather conditions, closure of the airports and seaports and similar event out of our control, or are due to unusual and unforeseeable circumstances beyond our control.

 

5. Complaints

 We do our best to provide our clients with enjoyable and trouble free services but occasionally plans go wrong due to any circumstances whatsoever. Should you have any complaint, please inform our concerned executive over the phone and email both, who will do everything possible to resolve the matter immediately. If the situation is not resolved to your satisfaction, then you must notify the company within 15 days of the tour ending in writing. If you do not write to us within this time, this will affect the investigation and outcome of the complaint.

 

6. Availing of our Services

 6.1 You must be at least 18 years old to avail of our services. In case of minors below 18, must be either accompanied by an adult or must be carrying the consent of parent /guardian as prescribed by the principals from time to time, to avail of our services

6.2 You agree to avail of our services only for lawful purposes and in accordance with all applicable laws and regulations of the country you are visiting.

6.3 You agree not to use our services to:

-Distribute any content that infringes the intellectual property rights of others.

-Distribute malicious software, viruses, or any other harmful code.

-Harass, abuse, threaten, or infringe on the rights of others.

 

 7. Using our website

7.1 To access certain parts of our website or information, you may need to create an account. You agree to provide accurate, complete, and up-to-date information when creating your account.

7.2 You are responsible for maintaining the confidentiality of your password and account, and you agree to notify us immediately of any unauthorized access or security breach.

 

8. Intellectual Property

8.1 The information within this website has been compiled with all reasonable care and is correct to the best knowledge of the company and is published in good faith.

8.2 All content on our website is for the promotion of a service amongst our prospective clients in good faith. We do not intend to breach any copyrights.

8.3 If there are any copyright infringements found related to any content, due to inadvertent error during the process of downloading by our team from the open forum on internet, and depicted/presented on the website, do kindly notify to us at ops@prathpl.com and we will remove the content with immediate effect.

8.3. Using any material including text, graphics, logos, images for the promotion of services of the principals on our website, shall have no legal or monetary bearings on us. 

 

9. Final Stipulations

The Terms and Conditions are subject to the State of Gujarat and Government of India Law. Exclusive place of jurisdiction for all relative disputes is Anand, Gujarat, India and client consents to said jurisdiction and venue
